Social endowment: too late to dispute its amount

COM should have done it earlier. This is the meaning of the decision rendered on March 9 by the administrative court of Saint-Martin in the case which opposed the community to the State concerning the amount of the health and social allocation.

As a reminder of the facts, when Saint-Martin became a COM, the State proceeded to the transfer to Saint-Martin of the budgetary envelope which was allocated to Guadeloupe to cover so-called social expenditure (RMI, social aid to the childhood, compensatory allowance for third person, personalized help) on Saint-Martin. But the COM estimates that the amount of the transferred amount, that is to say 3,7 million euros, was badly estimated.

The COM and its advisers consider the amount not offset at 7,9 million euros per year, or 71,23 million euros for the period 2008-2016.

The principle of transfer of the endowment and its amount were recorded in an interministerial decree published in the official journal on May 4, 2011. The COM had two months to contest it, which it did not do, underlines today Today the administrative court. "So this decree has become final with all the pecuniary consequences which are inseparable from it," he notes. It was for this reason that he rejected the COM's request, which had specified that during the time allotted to him in 2011. (soualigapost.com)
