Tourism: Seasonal rentals must now declare themselves to the COM

Today several hundred houses, villas or apartments in Saint-Martin are used as seasonal rentals or furnished tourist accommodation without the activity being declared, without the said furnished accommodation being the subject of an official listing .

To make up for this lack, the local authority, which has jurisdiction over tourism, has decided to modify its tourism code.

On January 31, it was therefore proposed to the elected officials of the territorial council to adopt a deliberation relating to the declaration of furnished tourist accommodation, a measure which was adopted unanimously.

Anyone operating tourist accommodation must therefore now make a "declaration to the COM by post or electronically", a specific form must be completed. For clarification, by tourist accommodation, the COM means a villa, a house, a studio or an apartment furnished for the exclusive use of the tenant, offered for rental to a passing clientele who makes a stay characterized by a rental at the day, week or month and the duration of which cannot exceed ninety successive days.

These declarations will allow the COM services to draw up an official list of seasonal rentals. And above all to be able to better collect the tourist tax from owners or management companies, that many do not pay it.

Persons who do not comply with the obligation to declare, may be penalized by a third class ticket, the maximum amount of which is 450 euros. (Soualigapost.com).
