Eight months in prison for theft in a meeting in a living room

On Sunday, November 18, at around 21 p.m., VW, 23, has just returned from work and has a drink on his terrace when he hears noise in his living room. To make a draft, he left his front door open. He gets up and arrives in the room, realizes that his console and his games have disappeared, as well as his cell phone and 180 dollars in cash. He sees two individuals running the other way while watching him. He then grabs his baseball bat and sets off in pursuit.

He will not go very far because he injured his knee two days earlier, and has just removed his splint. He turns around and finds his console and his games in a bag at the bottom of his building. On the road, in front of his residence, he meets a gendarmerie patrol which intervenes immediately. One of the two thieves, GL, 19, had the bad idea to return to the scene a few minutes later and was then arrested. He is placed in police custody and recognizes the facts but refuses to reveal the identity of his accomplice, apparently minor.

GL, 19, appeared on Wednesday November 21 before the criminal court of Saint-Martin in the context of the procedure of immediate appearance for theft of a meeting in a residential premises. "He is very well known to the court" indicates at the outset the court which will add a little later that "it has passed into the hands of all the judges". Indeed, this young man was, among other things, tried on Thursday for the use and possession of narcotics as well as violation of a removal order following a previous trial for violence. Until then, he had only received a stay and promised to take the right path. But the patience of the court has its limits.

"I am disillusioned" advances the vice-prosecutor in introduction to his closing statement. GL, who lives in an apartment his father left him, says he stole for food. "I am not a stupid child, but I have problems, I have no luck so I manage" he just explained from the accused's box. "You cannot strip others for food," replies the deputy prosecutor.

And to add "we cannot tolerate indefinitely that you come every week to court". Especially since according to him, there are aids in our society. He even advises her to go fishing. And requires one year in prison with a warrant.

Defense counsel are not sure what to plead. "It's the difficulty of getting to the end of the race," he says. Even if GL does not have enough to eat every day, the need is no excuse today because a number of measures exist for food aid. He explains that his client has tried to find work but that he never goes beyond his trial period. "Maybe he is lacking in skills," he comments. But tries to convince the court that sending GL to prison isn't going to do him any good. "We don't go to prison because we are hungry," he concludes.

After deliberation, the court found the accused guilty, sentenced him to eight months in prison and ordered his continued detention. GL left yesterday afternoon in Guadeloupe where he is incarcerated. The court receives the constitution of civil party of the victim who has to go on sick leave for fifteen days, the chase having rekindled his knee pain, and orders GL to pay him 330 euros for material damage and 500 euros for the non-pecuniary damage.
