JUSTICE: Six months suspended prison sentence for death threats and insults

The manager of a car rental company files a complaint against RD, a client's companion (who has not paid) because he has threatened to "behead" him. During the investigation, at the end of April, the gendarmerie called RD to summon him for questioning. He answers and insults the gendarme. A few days later, he sends six texts to the gendarme and threatens to "blow up the police station of Hope Estate", to kill her and her family. He also threatens to kill the prosecutor of Guadeloupe.

The gendarme files a complaint against RD for the same facts as the car rental company. RD is arrested. He was presented to the local court for immediate appearance on Wednesday morning. Assisted by a lawyer, he agreed to be tried. He partially acknowledged the facts but did not justify them. He confided that he was not violent and blames his aggressiveness on alcohol. He admitted having drunk two coca whiskey the night he sent the series of messages to the gendarme. Before the trial, they were examined by a psychiatrist who did not note any dangerous behavior.

In addition, during the search of RD's home, the gendarmes discovered 17 grams of cannabis. RD was therefore also prosecuted for possession and use of narcotics even though, as his lawyer pointed out, no official analysis of the drug was carried out.

The deputy prosecutor requested a one-year prison sentence with a probationary suspension including the obligation to care, work and contact the victims. After deliberation, the court pronounced the required sentence reduced by half and a probationary suspension of eighteen months.
