Housing: an untapped skill until now

If in areas such as town planning or taxation in which the Collectivity is fully competent, it has implemented its own regulations in other areas, it has done less, particularly in housing.

The COM received this competence in 2012 and, since then, is authorized to establish its own rules, the control of rents could be one of them. In France, rent control is provided for by law. The subject had been raised at the end of 2017 after the passage of Hurricane Irma when abuses had been denounced by the tenants. Several obstacles were then raised by the COM services; brakes that have not been lifted since.

Regulating rents means that it is necessary to define a grid, that is to say determine a price ceiling to be respected by geographical sector, by type of building. A work that would be announced as a real obstacle course and which risks generating disputes. The ALUR law also provides that municipalities interested in controlling rents must set up a rent observatory. Nothing prevents the Collectivity from creating its own. So far, no action has been taken. Recently the new term of office indicated that it wanted to “take full ownership” of housing competence by initially defining a local housing program (PLH).
