Court orders compulsory hospitalization "in an appropriate medical establishment"

The question sometimes arises in view of the behavior of the defendants: are they criminally responsible? In other words, can the court find them guilty of the offenses they have committed? To answer it, psychiatric expertises are ordered in order to seek the opinion of a doctor. This is what happened in the case of NC, twenty-four years old accused of violence with the use of a weapon, in this case an "unidentified object"; case examined Wednesday by the local court.

On April 15, VP, a young woman went to a mini-market in Quartier d'Orléans to do some shopping. In front of the establishment, she is attacked by NC who throws an object in her face, causing her two bruises. Treated in hospital, the victim has a 14-day ITT.

Following VP's complaint, NC is heard by the gendarmes. He denies all the facts with which he is accused and makes inconsistent remarks. A first psychiatric expertise is carried out in July and the doctor indicates that NC should be taken care of in a specialized establishment. A second expertise is ordered in September, the doctor specifies that NC has made a stay for a neuroleptic treatment and that he is not criminally responsible.

The deputy prosecutor thus requested that the young man not be criminally prosecuted but placed ex officio in a specialized establishment.

After deliberation, the court followed the requisitions by the prosecution. The latter must inform the prefecture of the judgment, which will issue an order stipulating compulsory hospitalization “in an appropriate establishment”. (soualigapost.com)
