Evasan: The hospital must compensate the TAI up to 100 euros

Transports Aériens Intercaraïbes (TAI) was selected in February 2009 by the Louis-Constant Fleming (CH) hospital center to provide medical evacuations for forty-eight months. But in June 2011, the CH had terminated the contract for "a reason of general interest".

TAI then took legal action to order the CH to pay him compensation for loss of earnings estimated at 1 euros; his request had been accepted by the administrative tribunal of Saint-Martin. The hospital appealed against this judgment and the administrative court of appeal of Bordeaux rendered its decision last August. It “[excludes] the company's right to compensation for loss of earnings and other expenses (overheads, aircraft rents) relating to the period of twenty-two months from the termination of the contract until the date initially agreed upon termination of services ”. It only retains the sum of 248 euros assessed by the administrative court of Saint-Martin corresponding to the “cost of acquiring the equipment necessary for the air transport services provided for in the contract”.

In the end, the Louis-Constant Fleming hospital center found itself paying the sum of 100 euros to the company Transports Aériens Intercaraïbes which asked for 000 million euros. (More details on www.soualigapost.com)
