The Collectivity has two choices for managing water: either under management or in delegated form within the framework of a delegation of public service.

In the days of the commune, the first option was in place. But in view of the deficit of the municipality attributed to the financial losses of the management, it was decided to take the management out of the budget of the municipality and to create an EPIC, namely the establishment of water and sanitation in Saint Martin (EEASM). As the name suggests, it is in charge of drinking water and sanitation in the French part.

Its director is Patrick Lentz and its president (of the board of directors) Dominique Riboud. The presidency is always held by an elected representative of the territorial council.

Who is the delegate?

The COM has also chosen to delegate management. Until the end of 2018, there were two delegatees: one for the production of water (Ucdem) and one for the distribution (Générale des eaux).

The WDM having asked to terminate its contract in advance, the COM took the opportunity to do the same with the UCDEM; the objective being to entrust the two services to a single delegate. At the end of 2018, Saur was chosen to provide these two services. Saur produces and distributes drinking water through a network belonging to the COM.

What is the role of the President of COM / EEASM?

Since the French Revolution, the distribution of water has been a municipal or territorial public service in the case of Saint-Martin. According to the general code of local authorities, the mayor or president is the guarantor of public health, the first responsible for the quality of the water which is distributed on its territory but also for the quality of the resources located on the territory. It must also ensure the information of the population.

The president of the COM or the EEASM present to the territorial council is required to present an annual report on the price and quality of the public drinking water service intended in particular for the information of users; this is what is done each year by all of the COM satellites.

What is the role of the manager production and distribution?

He is directly responsible for the quality of the water. It is required to continuously monitor the quality of the water produced and distributed by carrying out a regular examination of the installations, a test and analysis program and by drafting a sanitary file.

The delegatee must also submit before June 1 of the year a report to the delegating authority, here EEASM / COM, a report comprising in particular the accounts retracing all the operations relating to the execution of the DSP and a analysis of the quality of service according to the general code of communities. This report is accompanied by an appendix allowing the delegating authority to assess the conditions of execution of the public service. As soon as this report is communicated, its examination is placed on the agenda of the next meeting of the deliberative assembly (territorial council) which takes note of it.

The report must also be made available to the public within 15 days of its receipt by the community. This report notably includes the annual account, the state of the assets, the analysis of the service rendered to users, etc.

Who provides food security

drinking water?

Health is a competence of the State despite the statute of Saint-Martin. Food security is therefore ensured by the regional health agency (ARS) and the prefecture.

In conjunction with the prefect, the ARS must carry out water analysis programs and a health assessment of the results; the samples being sent to a laboratory approved by the Ministry of Health.

The ARS must also inspect the water production and distribution installations and inform the president of the COM / EEASM and the person responsible for water quality management.
