SINT MAARTEN: She goes to court to gain access to her mother's medical file

His mother, domiciled in part Dutch, died on October 13, 2020 at the age of 63 following a cardiac arrest which occurred five days earlier. The cardiologist who declared the death, specified that he did not know the causes of this cardiac arrest. Also an autopsy in agreement with the family, she was requested. But it could not take place “due to covid-19”.
The daughter of the deceased is convinced that her mother died of an overdose of drugs administered by staff at a health facility in Sint Maarten where she had been cared for for a long time.
In view of these elements, the daughter of the deceased wishes to file a complaint and for that, she needs her mother's medical file, a file which was refused to her. She then seized the court of first instance of Sint Maarten to order the medical establishment to have access to the medical file.
The court considers that the daughter of the deceased is within her rights to have access to her mother's medical file. The health establishment had fourteen days to communicate it. A fine of $5 per day of delay was also pronounced. (soualigapost.com)
