Depending on the nature of the work, the client (individual, company, institution) must request authorization from the town planning services of the Collectivity. The file is either a preliminary declaration of work (DP) or a building permit (PC). The files must be submitted upstream of the construction site, which cannot begin without a favorable opinion from the COM services validated by the executive council.
In 2021, some 200 building permits were processed and 115 preliminary work requests. Slightly less than a quarter of applications were granted tacitly. That is to say that the town planning services did not give an answer to the petitioners within the allotted legal time, so the PCs and DPs were granted automatically. However, this does not mean that the planned works comply with the town planning code or the land use plan (POS).
Checking compliance is the role of the legality control of the prefecture. If the agents find irregularities, they can contact the services of the Collectivity so that the file is withdrawn.
In other cases, the prefecture takes the case to the administrative court to have a permit or declaration of works cancelled. It recently did so for four building permit files, which had received tacit agreement in March and May last year. The hearing will take place Thursday in Guadeloupe.
