The Collectivity wishes a relaxation of European standards on its territory, to take into account the economic specificities of Saint-Martin

In continuation of the questions raised within the 24th Conference of Presidents of the ORs, which took place in Saint-Martin from February 5 to 8, the Collectivity of Saint-Martin consulted the representatives of the 3 main sectors, the latter weeks, in order to assess with them the needs or avenues for deviation from certain European standards conditioned by our status as an OR.

Indeed, article 349 of the Treaty on the Functioning of the European Union (TFEU) allows the adoption of derogatory measures and of adaptation to our specificities and this, a fortiori since the advent of favorable jurisprudence (the “Mayotte” judgment of the CJEU thus recognized and clarified the right of the ORs to derogate from European regulations on a certain number of subjects and for a substantial period).

In a letter addressed to the main local professional associations, the president Daniel Gibbs recalled the ambition of the Collectivity and its elected officials to see a stricto sensu application of the provisions of article 349 of the TFEU, “so that they are fully and loyally implemented ”.

Within the Collectivity, the Economic Development Delegation has been designated as the pilot of the work that will be carried out with the representation of socio-professionals in Saint-Martin.

A first progress report aiming to list and quantify the most significant grievances will soon be presented to President Daniel Gibbs and to the Vice-President of the delegation for Economic Development Yawo Nyuiadzi.
