XD was presented for immediate appearance before the Criminal Court of Saint-Martin on Friday February 22 for two series of facts committed to the prejudice of LU, his companion. One concerns violence with three aggravating circumstances: on his concubine, with a weapon and in a state of intoxication. The other was malicious calls and death threats.
In a relationship with LU for a few weeks, XD moved into her home in July 2018. She lives with her two young children and he shares custody of hers (7 and 9 years old) with her ex-partner. Everything seems rosy in this blended family. However, although very recent, their relationship is already floundering. On January 20, XD came home in the evening around 7 a.m. and went straight to bed. But LU prevents him from sleeping and points out to him that when you have children and that you go out you have to assume and take care of them. In his complaint, LU describes: “he told me that he was going to puncture my eyes and break my French nose so I spat on him and he beat me on the head. Then he grabbed the Japanese kitchen knife with which I had just cut fruit for the children who were having breakfast, and chased me around the kitchen table. ” LU can't run fast because she has one foot in a splint. An injury following another argument, which occurred between them two days earlier. So she goes under the table and curls up to protect her head. XD strikes it three times between the two shoulder blades with the flat of the knife. She called the gendarmes for the first time. LU is then examined in the emergency room and leaves with a 1 day ITT and a 21 day sick leave. She is then heard at the gendarmerie. Her statements refer to recurrent domestic violence in the presence of children. XD is placed in police custody. If XD already has three convictions to his credit, he has never been the subject of a complaint for domestic violence and has good relations with his ex-companions. Considering that he did not represent any particular danger, he had been released after his police custody but had nevertheless been banned from contact with LU It was for failing to comply with this ban that he appeared before the tribunal. Two days after being released from police custody, XD sent messages to LU through a friend asking him to return his business to him. LU also received a message from another number a little later with a death threat, without proving that XD was the originator.
After deliberation, the court acquires XD for the facts of malicious calls and threatens to kill, but finds him guilty of the remainder. He was sentenced to two years in prison, one of which was suspended with probation for three years and prohibited from contacting the victim. He must also compensate the victim and carry out an awareness training.
