The executive council appointed a territorial attaché in 2013 and a territorial engineer in 2015 to the position of assistant general manager (DGA) within two poles of the community. The contracts expired in 2018 and were renewed until 2020 and 2023. The renewal conditions were denounced by the prefecture services because they did not comply with regulations.
Two points were raised by the prefecture and confirmed by the judges. On the one hand, it was not for the President of the COM to act on the decision of the two detachments but for the Executive Council, the only body competent to appoint people to functional posts at the COM. On the other hand, the two people did not meet the conditions for obtaining the post of DGA, precisely in terms of index. The administrative court therefore decided to annul the two orders relating to their secondment to the functional post of deputy director general of services for the community of Saint-Martin.
