JUSTICE: Daniel Gibbs and Annick Petrus have been released

The second and final part of the so-called elected officials' trial was held last Thursday: Annick Petrus and Daniel Gibbs appeared before the Saint-Martin local court for acts of infringement of freedom of access or equality candidates in public contracts. 

This company is Angel Car Rental managed by Jean Delice Murat. It provided services between January 2018 and March 2019, in this case it assisted the community in the distribution of food and other donations. The value of the contract amounted to some 147 euros. However, it was selected without having been put in competition as the code of the public order imposes it. This is why the last five invoices amounting to some 400 euros have not been paid by the public treasurer and have been the subject of a settlement protocol in order to be regularized. This protocol was denounced by the prefect at the time to the public prosecutor.

The judges took turns questioning Daniel Gibbs and Annick Petrus to understand the course of events. It emerged from the investigation that Daniel Gibbs did not intervene directly in the choice of service provider but when he had to regularize the situation. As for Annick Petrus, she claims to have suggested the company to the purchasing department of the COM and asked it to see if it was in order and then to have received the agreement of the director of the president's cabinet. 

After deliberating for almost 1h30, the court followed the requisitions of the prosecution and released the two defendants on the grounds that they acted in an emergency situation after Irma, that such a situation authorizes non-compliance with the rules of the public order.
