In his plea, the civil party insisted on the former skills of driving school instructor of AB; so he should have known that he should not drive after drinking and not exceed the authorized speed.

"By taking the road, we each have a responsibility, an obligation", admits the prosecutor for whom our vigilance must be even greater "given the lamentable state of our roads". “We need to be over-vigilant. AB knew the state of our roads and thus had an obligation to adapt his driving, ”he agrees. A vision that master Pierre-Yves Chicot does not share. While he recognizes that motorists must be careful, they should not however bear the lack of responsibility of communities for not properly maintaining the road network. "The COM of Saint-Martin contributed to the damage, the accident ... Since then it has also repaired its fault by lighting the road," he notes.

The penalties required

Following new investigations, AB and DB were also prosecuted. The prosecutor requested a fine of 1 euros against DB, six months suspended prison sentence and a fine of 000 euros against FR. A heavier sentence has been requested against AB, ie eighteen months in prison, half of which is suspended. The court reserved the judgment; it will be returned on November 1th.

Note that FR is still being prosecuted for manslaughter but the prosecutor has nevertheless requested his release. Even if the debates established that he was not responsible for the accident, the procedure does not allow this accusation to be quashed; only a judgment can notify it. The court which will join the two cases will rule on the acquittal on November 25 as well.
