Gendarmerie: Summoned for a blood alcohol level, he goes behind the wheel of his vehicle while his license has been withdrawn

At the end of April, mid-morning, at a road police checkpoint in Marigot, an individual driving a bus is subjected to a blood alcohol test (NB: the bus was empty of passengers and in good standing with the legislation on public transport).

As the latter is positive, the driver is taken to the Savane barracks in order to carry out the verification with a breathalyzer: an alcohol level of 1 mg / l of exhaled air is then observed (i.e. close to 22 , 2,5 g of alcohol in the blood).

The gendarmes then initiate a procedure for driving a vehicle under the influence of an alcoholic state (offense). His license was immediately withdrawn and his vehicle was immobilized. The offender is invited to appear a few days later to be heard on the facts.

The day of his convocation, he presents himself at the Savane barracks…. driving his bus.

Thus, having already been convicted for the same acts in the past, he is therefore being prosecuted today for repeat driving of a vehicle under the influence of an alcoholic state (offense), for driving a motor vehicle despite an administrative or judicial suspension of the driving license (offense).

Faced with the profile and background of this bus driver, the prosecutor decides, in addition to the 6-month suspension of his license, to seize his vehicle until his appearance scheduled in September under article L 131-21 * of the Code Criminal.

* Confiscation relates to all movable or immovable property, whatever its nature, divided or undivided, having served to commit the offense or which were intended to commit it, and of which the accused is the owner or, subject to rights of the owner in good faith, of which he has free disposal.
