The images show that the car drives at low speed unlike the helmeted pilot of the two-wheeler, its high speed will be confirmed by witnesses. He was passing the cars when he struck CL's rearview mirror, which had shifted slightly to the left to avoid the trench. “As he was driving very fast, he was unbalanced,” notes the deputy prosecutor. "On the other hand, I do not see in the images that CL's vehicle crossed the center line of the road while trying to avoid the trench," the court noted.

In his indictment, the vice-prosecutor requested the release of CL because his responsibility has not been demonstrated. After deliberation, the court released CL who was still in a very emotional state at the hearing.
