Last Saturday in the middle of the afternoon, CC, a young woman, takes a walk on Happy Bay beach with her dog. The animal detects a man hidden behind the bushes.

She decides to return to the parking lot at Friar's Bay beach where she left her car. She takes a small path but realizes that she was wrong. She notices that the man who was hidden is following her. He takes out his penis, masturbates. She manages to return to Happy Bay beach to take the other path - wider - which leads to the portal, near the RN. The man follows her, catches her, takes her by the shoulder. He takes out the pair of scissors he had in his bag and points them at CC's stomach. She pushes him and runs away. At the gate, she calls the gendarmes, or her colleagues, since she is also a soldier.

On their arrival, the gendarmes take CC to Friar's Bay to try to find the individual. After some hesitation - he had changed his t-shirt and tied his hair up - she recognizes him. MC was arrested, placed in police custody and then in pre-trial detention pending his appearance before the local court of Saint-Martin for immediate appearance.

He is being prosecuted for sexual exhibition and violence with a weapon.

The hearing took place on Wednesday morning. At the bar, he recognizes the facts but gives a different interpretation. He clarified that he was urinating and that she was watching him. "I asked her if she wanted to see my cock," he told investigators. He confirms that he followed her because he wanted to apologize for having urinated in front of her.

Regarding the pair of scissors, he also admits having taken it out of his bag but to protect himself from CC's dog. "My dog is useless… she is more afraid than anything else", underlines CC when the judges question her about the species of the animal, in this case a small coconut tree.

A medical expertise of MC, aged twenty, was carried out; the doctor noted "a possible dangerousness" but without "conscious intention" to be violent. "He is a child in a man's body, he is not fully aware of the prohibitions of society," commented his lawyer.

MC has already been convicted twice but for other facts. However, the civil party's lawyer revealed that MC's name appears in 19 factual files relating to sexual assault, files in which he was simply heard.

For the prosecutor, "the guilt of the accused is obvious". "The victim who is a gendarme and who is used to procedures, is able to tell the difference between someone who urinates and someone who engages in a sexual exhibition", he agreed before requesting a sentence of one year in prison and a warrant of committal against MC.

After deliberation, the court pronounced a sentence of eighteen months in prison, six of which accompanied by a probationary suspension of two years including the obligation to follow care and work. A ban on holding a weapon for five years has also been imposed. Registration in the automated judicial file of perpetrators of sexual and violent offenses (Fijais) was ordered as well as ineligibility for five years; two additional automatic penalties. His continued detention was not requested by the court, which however advised him not to return to Friar's Bay.

The victim was also received in his civil party constitution; MC must compensate him up to 2 euros for the damages suffered and 500 euros under article 1-000 (attorney's fees) of the Code of Criminal Procedure.
