Domestic violence: two months suspended prison sentence

A 65-year-old man with a cane, TE, appears before the Saint-Martin local court. He is accused by TL, his wife, of violence.

On June 22, 2021, TE and his wife are at home, their daughter is also at home. At 20 p.m., after one of many heated arguments, TE goes to his bedroom, his wife is about to do the same when TE comes back into the living room and punches her hard in the mouth. TL falls to the ground. Their daughter intervenes, "jumps" on her father in order to prevent him from continuing.

According to the testimony of the couple's daughter and wife, violence and insults have been regular for more than thirty years.

The defendant denies the charges against him. He claims he just 'pushed' her after she felt a slap on her cheek. He also says he wants to "protect himself from her", that she threatens him with death, that she "beats him up".

“For 33 years this couple has been toxic for both of them, destroying each other morally, physically with two girls in the middle who must be shared”, comments the prosecutor. “It is our responsibility, justice, to prevent one day one of the two from dying,” she agrees.

After deliberating, the court sentenced TE to a two-month prison sentence accompanied by probationary suspension for eighteen months, including a ban on entering into a relationship with the victim.
