A child is the victim of aggression or violence on the part of one of his parents, the facts are denounced and the parent author of these facts is prosecuted. As a victim, the child is also called to appear. Being a minor, the child must be represented by his other parent.

However, this representation can turn out to be tendentious, delicate. Indeed, the parent may seek to minimize the facts with the child so that the other parent is not condemned. At the bar of the court, the interests of the child will not be properly defended. This is why there is a special procedure in France in this type of situation: the appointment of an ad hoc administrator. In Saint-Martin, this role has recently been exercised by the Trait d'Union victim assistance association. A lawyer has been specially trained for this purpose.

An ad hoc administrator is a person appointed by the judge or the public prosecutor, to represent the minor and defend the interests of the latter in a pending legal procedure. “He sort of takes on the role of the parent in court. He will explain the situation to the child, find him a lawyer, fill out the legal aid file so that the lawyer is paid by the State. Outside the framework of the procedure, the ad hoc administrator does not intervene in the daily life of the child and is not intended to be a foster family. Its role is only to be alongside the child in court, ”explains Olivier Fatou of Trait d'Union.

The exercise of this function is a new service offered by the local association of assistance to victims which receives 90 people per week (all damages included).
