Garage owner sentenced to prison for receiving stolen goods, breach of trust and fraud

The criminal court of Saint-Martin released Thursday its February 28 deliberation in the case for which the main defendant, P.AV, a garage owner of Concordia was prosecuted for concealment, breach of trust and swindle. The examination of this file required eight hours of hearing on January 24. 

P.AV appeared for insurance fraud with the complicity of an insurance expert, MJY.P, summoned the same day. The garage owner and car rental company was accused of having declared seven fraudulent claims between May 2013 and December 2015 on vehicles in his fleet. A scam that brought him 65 euros for repairs to be carried out in his garage.

P.AV was also prosecuted for several concealment offenses. P.AV was also accused of breaches of trust. He had several times rented and sold as if it were his own, the vehicles that an individual, then a bailiff had entrusted to him as security. Finally, one of his former employees criticized P.AV for having orchestrated a scam when purchasing a vehicle bought with a bad check.

The court declared all the defendants guilty of all the acts with which they were accused:

- P.AV, the garage owner, was sentenced to twenty-four months in prison, twelve of which were suspended, as well as a ban from managing or directing any business related to the automobile for five years. He was also sentenced to a fine of 10 euros and the court ordered the confiscation of the seals. The court therefore followed the prosecution's requisitions but doubled the amount of the required fine.

- MJY.P, the insurance expert, was sentenced to two months suspended prison sentence and a 1000 euros fine.

- the court also followed the requisitions of the public prosecutor's office against SC the buyer of the vehicle of the ex-employee of P.AV who had provided the bad check and sentenced him to three months in prison.

OV, in whose hands the vehicle bought with a wooden check and therefore stolen was found was sentenced to six months in prison, in accordance with the requisitions.

- finally, the court sentenced D.FL to two months suspended prison sentence for registering a stolen vehicle on the Dutch side at the request of P.AV.

The court also received the constitution of the civil parties (insurance companies, victims of the scam of sale of the vehicle, victim of the breach of trust) and pronounced the reference on civil interest to June 25 next.
