The father, 50, and the son, 23, are summoned together in the same case before the criminal court of Saint Martin on Thursday, December 20. The first is prosecuted for possession of a Category B weapon without authorization, the second for using the weapon and threatening a minor with it.
The facts took place last September in Quartier d'Orléans. While the father has left for work, the son sleeps at home when he hears noise on the terrace. He gets up and sees the neighbor's son with a machete. He decides to scare her by brandishing a weapon, in this case his father's gun. The minor's mother will file a complaint with the gendarmerie.
At the bar, the father explains that the kid regularly causes neighborhood problems. He is also in conflict with the mother - his tenant as well - who has not paid the rent for a year; so he cut off the water and electricity.
"I did not want to fight, just to scare him," said the son in turn to justify the use of the weapon. "My son knew the gun was not working," said the father. "The weapon has been analyzed and the results confirm its neutrality, it is considered a decorative weapon which must be stored in a cabinet," said the deputy prosecutor, who then asked for the father's release. Against the son, he requested a fine of thirty days to ten euros.
After deliberation, the court finally sentenced the father to a fine of 800 euros and to a ban on holding a weapon with authorization for five years and the son to a fine fine of sixty days at ten euros. The rifle was confiscated.
