The lawyers of Saint-Martin and Saint-Barth mobilized against the justice bill

The lawyers of Saint-Martin and Saint-Barthélemy mobilized last Wednesday as part of the national movement "Justice for All Day" before the Court of Marigot to express their disagreement with the passage in force of the Justice Bill which aims to dematerialize legal proceedings.

The lawyers, supported by the President of the Court and the Registrar, oppose the bill which provides in particular: the dematerialization of the notification of rights in police custody; the systematic extension of provisions derogating from common law such as the general use of video-hearing, deferred appearance, extensive use of procedures without a hearing; the abolition of district courts (popular juries), replaced by professional magistrates; the general decline in the control of the judicial authority over the activity of the police services; and the specialization of appellate courts announcing a risk of the disappearance of certain forward prices.

In short, it is a matter, according to the press release published by the Bâtonnier of the Order Bernard Pancrel, of dehumanizing justice by reducing the importance of the role played by the lawyer and the jurors before the courts, of reducing the '' access to the judge under suitable conditions and to be confronted with justice from the strongest against the weakest, from the easiest against the most destitute.

The Bar Association of Guadeloupe, Saint-Martin and Saint-Barthélemy said in a press release that the Justice Bill "sacrifices the public service of justice to purely budgetary considerations". Consequently, on Wednesday 12 December, they paralyzed all the hearings by refusing all the services of oral argument and all the filing of files.

All the courts of France were closed on Wednesday December 12 in order to protest against this bill and the method used to force it through. The President of the Bar Association of Guadeloupe was received by the sub-prefect of the region in order to publicize the demands for the maintenance of the rights of citizens, the exercise of their profession and particularly with regard to local specificities .

The USM and UNSa-SJ call for continuing this mobilization from the start of 2019, in particular by boycotting the start-up hearings.
