JUSTICE: One year in prison for having exerted violence on his partner

CH aged thirty-six appeared Wednesday morning before the Saint-Martin local court for acts of domestic violence. On March 12, he was already convicted of the same crimes against the same woman.

CH has been in a relationship with the victim for fourteen years, but they do not live together. He spent part of the day of June 5 - the day the facts unfolded - with friends. He admits to having drunk but "not to be drunk". "We drank four bottles of wine for four and six beers," he told the court. His blood alcohol level was 0,56 mg / liter of exhaled area, the authorized rate being 0,25.

CH explains that his partner never stopped calling him that day. In the evening he wanted to go see her, he interpreted the fact that she was alone - her daughter being absent - by the fact that she was with another man. So he knocked on his door a little before midnight. Seeing that he had been drinking, she refused to open him.

He still forced the door and managed to enter. "I went into the kitchen to get a glass of water ... She took a meat pick, so I took her hand ... I was also trying to turn the pick ... And that's when I let go of my hand , that the pic hurt her, "he tries to explain to the magistrates. In the dispute, a fork was also grabbed and twisted.

A neighbor saw part of the scene and told the gendarmes that the couple was on the ground, that CH was above her and that he hit her; a medical certificate will confirm bruising. It was this same neighbor who warned the gendarmes.

Upon their arrival, CH had already left behind the wheel of a car when he had been drinking and was not the holder of the French driving license, two traffic offenses which he is also accused of.

The victim did not wish to be a civil party, his only wish is that he "leave her alone".

The prosecution requested a sentence of sixteen months in prison, ten of which were suspended. After deliberating, the court imposed a sentence of twelve months in prison, a ban on driving any vehicle for six months and carrying a weapon for five years. He did not, however, request his continued detention. CH will soon be summoned by the sentencing judge to adjust his prison sentence in Saint-Martin (with an electronic bracelet). But at the slightest misstep, "you will go to prison in Basse-Terre", assured the court. "Today was your last warning. " (soualigapost.com)
