JUSTICE: Eighteen months suspended prison sentence for stealing a car with a dummy weapon

They weren't proud of the courthouse. JT and CL, aged 23 and 21, respectively, were appearing before the local court of Saint-Martin for having participated in an aggravated theft two years earlier.

The two did not argue and admitted the facts. On the night of August 11, 2018 at around 2 a.m., they were in a vehicle following two other cars. They are passengers, one went to Cole Bay, the other to Marigot. On the descent from Morne Valois / Friar's bay, the driver overtakes the two cars in front and will force the first to stop.

CL then gets out to threaten the driver of the stopped car with a dummy weapon. The latter defends himself and takes a blow to the head. Seeing that CL is not in control of the situation, JT gets out of the car in turn to go and help him. He "raises his arms" as a sign of pacification and asks the victim to leave his friend. She complies and walks away. CL gets into the victim's vehicle and flees.

"What is staggering is the trivialization of pulling out a weapon and committing violence with it," commented the deputy prosecutor before requesting a three-year prison sentence, one year of which is suspended. He left it to the discretion of the court to issue a warrant of committal or not.

After deliberating, the court sentenced the two young men to eighteen months in prison with probationary suspension of two years including the obligation to work and to repair the damage committed. CL is also prohibited from owning a weapon for five years. The victim's civil action has also been received, CL and JT must pay them jointly the sum of 2 euros for the moral damage suffered.
