Decryption / Smic, health, environment: what changed on January 1, 2020

Several measures taken by the government entered into force on January 1, 2020. Most of them are applicable in Saint-Martin except those in areas where the COM has jurisdiction, including taxation or transport (permit at 1 euro). However, the following measures are applicable on the territory:

• Revaluation of the minimum wage

The minimum interprofessional growth wage (Smic) was increased by 1,2% by decree of December 19, 2019. The new amount of the gross hourly Smic is therefore € 10,15 since January 1 (versus 1003 euros), or a gross monthly amount of 1 euros based on the legal working time of 539,42 hours per week.

In 2019, the minimum wage increased by 1,5%.

For its part, the guaranteed minimum is € 3,65 on January 1, 2020.

• Glasses, dentures, hearing aids

As part of the so-called 100% health reform, new reimbursement provisions for glasses and dental prostheses specified in the decree of January 12, 2019, came into force on January 1.

In terms of optics, the amounts of support vary depending on the type of correction prescribed (up to € 800 for progressive lenses) with, for the frames, a maximum reimbursement of € 100 in all cases.

These guarantees will be limited to one pair of glasses per two-year period (with the exception of cases for which early renewal may be provided, in particular for children under 16 and in the event of changes in vision).

These provisions relate to contracts signed or renewed from 1 January 2020 for glasses and dental prostheses and will relate to contracts for hearing aids from 1 January 2021.

• Environmental

Disposable plates, cups (sold in batches), glasses or even cotton swabs: certain single-use plastic products are prohibited for sale from January 1, 2020 according to article L541-10-5 of the environment code .

Bottled plastic water bottles present in school canteens are also prohibited from this same date (except in case of restriction of water intended for human consumption for food uses).

A decree published in the Official Journal of December 27, 2019 also specifies that a single-use plastic product is defined as a product made entirely or partially from plastic and which is not designed, created or placed on the market for be reused for a use identical to that for which it was designed.

• Reduction of the duration of sales

The PACTE law modified the duration of the sales from 1 January 2020. The sales periods are reduced from six to four weeks. The 2020 winter sales will therefore begin on January 8, 2020 and will end on February 4, 2020 on the national territory and those  summer Wednesday June 24 to Tuesday July 21. By way of derogation, in Saint-Martin and Saint-Barthélemy, the sales take place at different times of the year: they were thus fixed from Saturday May 2 to Friday May 29 and from Saturday October 10 to Friday November 6 this year.

• Stamp price increases

The price of the green stamp (normal rate) is 0,97 cents and that of the red stamp (priority letter) 1,16 euros. They increased by 9 and 11 cents respectively.

• Mandatory electronic invoicing for very small businesses

In the context of public procurement, dematerialized invoicing has also become compulsory for very small businesses (less than 10 employees). This provision was made mandatory for large companies on January 1, 2017, mid-size companies in 2018 and VSEs in 2019.
