In its decision of last November 30, the Council of State indicates that the Collectivity is authorized to introduce the levy of 30% on the base part of the RSA, thus rejecting the appeal of the prefecture.
The Council of State finally considered that the Collectivity had the fiscal competence to carry out such a levy. It was during the Territorial Council of October 30, 2014 that elected officials adopted the tax levy of a rate of 30% on the base active solidarity income (RSA). The objective of this decision, which has caused much ink to flow, is to allow the COM to amortize the colossal cost of the RSA. By letter of March 5, the representative of the State Philippe Chopin informed President Aline Hanson that he had seized the Council of State in order to obtain the cancellation of the deliberation. The executive council of March 24 then authorized the president to defend the Collectivity in the context of this appeal brought before the highest administrative court in France.
