Circulation: The Collectivity regulates the conditions for loading and transporting goods on public roads

By territorial decree N ° A-2728/2021, the community of Saint-Martin sets the rules applicable to the loading and transport of goods by heavy or light transport vehicles (trucks or vans) specially designed to load and transport goods by transport professionals and individuals. 

It is the owners and / or drivers of heavy goods vehicles or utility vehicles (dump trucks, flatbed, load carriers, tupie trucks) to take all necessary measures, when transporting goods, in bulk, crates, cardboard boxes, waste , various debris, perishables, gravel, sand and construction materials, live animals or other volatile products.

The carrier or individual who ensures the packaging of the goods checks that the load is well secured and does not compromise the safety of road users, the protection and cleanliness of public roads. 

In order to avoid any loss of goods on the roadway and to avoid any endangerment, all carriers are required to apply the following regulations: 

- It is the client's responsibility to ensure that the vehicle put into service has the chains, tarpaulins and accessories necessary for the safety of the load;

- During transport, the goods transported must be chocked, strapped, stowed or covered, as the case may be;

- At the rear, the load of a vehicle (or a trailer) must not exceed more than 3 meters, the end of the vehicle or the trailer;

- In case of overtaking behind, a sign will be installed from 1 meter;  

- In the event of loading several consignments in the same vehicle, the driver must ensure that any new loading does not affect the goods already loaded; 

In the event of overloading and non-compliance with this decree, offenders are also liable to the following fines:

- For -3,5 tonnes, exceeding the total authorized load weight is sanctioned by a fixed fine of € 135, reduced to € 90 if payment within three (3) days, increased to € 375 if payment after 45 days . The amount of the fine will be doubled if the overload exceeds 500 kg;   

- For + 3,5 tonnes, in the event of overload observed, drivers can pay 4th class fines, up to € 750. If the observed overruns exceed the regulatory limits by 20%, 5th class fines are applied up to € 1500, or even € 3000 in the event of a repeat offense.  

Any violation found will be prosecuted in accordance with the laws and regulations in force (see Articles 5 and 6 of this decree). If necessary, the carrier or driver will be held responsible for damage resulting from the transport of the goods.
