A restaurant manager in Saint-Barth sued

The manager of three establishments (restaurants, night clubs) in Saint-Barthélemy is accused of having paid her employees “cash salary supplements” between 2011 and 2015 without having paid the corresponding social charges.

At the helm of the court, CG, explained that the sums in question corresponded to tips or tips left by customers. However, the practice, according to the prosecution and the gendarme, did not comply with the regulations.

The investigation revealed that CG centralized the tips paid by credit card which is illegal and also granted some of them. She is also being prosecuted for covert work. Six of her employees, whose contracts stipulate 43 hours of work per week, filed a complaint against her and accused her of failing to report between 25 and 32 hours of work. In front of the magistrates, CG confided to be the victim of a trap. A few years ago one of his clients told him that some of his employees stole it. Puzzled, she began to watch them and discovered that more than a thousand bottles had disappeared and that the employees were increasing the bills to inflate the tips. "They did not like that I suspect them and watch them," she says. The prosecution requested the confiscation of the defendant's villa, the value of which is estimated at 1,6 million euros and a fine of 75 euros against the legal person. He also asked for the judgment to be published in the newspapers. After more than six hours of hearing, the court reserved the judgment. It will be returned on June 000.
