A father lends his uninsured car to his son who does not have a license

“Making his vehicle available to a third party whom he knows does not hold a driving license constitutes the offense of complicity in driving without a license”.

The prosecutor reminded SO, a father tried by the Saint-Martin local court for these facts last week.

SO was summoned for having lent his car to his son when he knew that the latter did not have the license. The vehicle was also uninsured. He was absent from the hearing but represented by his lawyer.

For her, her client cannot be found guilty of the lack of insurance insofar as “the license plates of the vehicle were false”. “It is difficult to insure a car with false plates,” she conceives.

Regarding the other offence, that of complicity in the lack of a driving licence, she requested the cancellation of the procedure because the name of her son indicated in the file is incorrect. 

After deliberating, the court found SO guilty of the lack of insurance and sentenced him to a fine of 400 euros with a suspended sentence. On the other hand, he released him from the lack of a driving license and ordered the return of the vehicle which had been seized by the gendarmes.
