One year in prison for throwing stones at a gendarme during a savage run in Bellevue!

He was facing up to seven years in prison, the prosecution requested two with a deposit warrant and the court imposed a sentence of one year in prison against a young Saint-Martin (FRS) who threw stones at a gendarme during a wild run. He was tried last Friday by the criminal court of Saint-Martin in immediate appearance.

The facts occurred on the morning of Sunday April 7 on the road to Bellevue. The gendarmes arrive on the scene and see a number of people standing on the side of the road waiting to witness a wild run. They make a first passage by vehicle and return to park near the entrance to Marigot. They descend and try to arrest an individual whose two-wheeled vehicle cannot start. "It does not please others and there will be a rain of stone and the situation escalates," reports the president of the criminal court by reading the minutes of the gendarmes. FRS explains that the soldiers "attacked" the young person which made him "up set", which irritated him. "And spontaneously he imitated the others by throwing stones", specifies his lawyer.

The young accused tried to deny certain facts, in particular that of having launched projectiles twice. "But the gendarmes were equipped with cameras and filmed the scene," said the judges. On the film which was broadcast at the hearing, we see FRS driving on a scooter towards the gendarmes, getting out to take a stone, throw it and leave. Then we see him come back, on foot this time, grab a stone again and throw it towards the soldiers. One of them is injured in the head and will have a two-day sick leave. He took legal action.

"A strong signal" sent

FRS tries to defend itself by saying that we do not see that it is "his" stone which reached the head of the gendarme. He admits that he doesn't know why he did it, "I didn't think about it." Looking at the victim, he apologized. His lawyer also points out that his client presented himself to the gendarmerie “once the nervousness came down”. "He is the only one who went to the gendarmerie," she said. FRS also started taking driving lessons but stopped them for lack of money.

The deputy prosecutor was very severe and wanted to send "a strong signal". FRS committed violence with three aggravating circumstances (in a meeting, with the use of a weapon in this case stones and on a gendarme) but also drove a 500 cc scooter without a license. "The accused has already been convicted twice for driving without a license, the criminal response must be immediate," he agrees, recalling that one of the young people who killed himself last Monday in a road accident in Quartier d'Orléans had also been convicted of driving without a license.

"The gendarmes are on a mission here to serve France but also the Saint-Martinois," he insists. And to mention Constable Klein who died in 2006 in the same place after being hit by a motorcycle. “The gendarmes did not attack a young person, they arrested someone who had committed an offense, he was driving without a helmet with a firecracker. Young people behave in a stupid, irresponsible and super dangerous manner, ”said the deputy prosecutor, who also asked for a warrant.

After deliberation, the court sentenced FRS to one year in prison,  a ban on driving any motor vehicle, even those that do not require a license for six months, and two fines of 100 euros each. He also ordered the confiscation of the scooter.
