The Collectivity of Saint-Barthélemy and the Prefecture of Saint-Barthélemy and Saint-Martin wish to recall a few simple rules regarding access to work for non-EU foreigners.

To work in Saint-Barthélemy, each non-Community foreigner must have been expressly authorized to do so by a deliberation of the Executive Council of the Collectivity, and only of the Collectivity. This rule admits of no exceptions. The authorization request is the responsibility of the employer. Residence permits (“employee” residence permit, “private and family life” residence permit, residence permit, receipt of application for permits, etc.) issued by the State cannot under any circumstances authorize work on the island. . The mention "authorizes work in Saint-Barthélemy" appearing on residence permits issued by the State has not been updated for the specificity of Saint-Barthélemy. Residence permits only authorize entry and stay on the island, not work.

In addition, the work permit issued by the Collective only applies to a given job. In the event of a change in employment contract, a new authorization must be obtained from the Collectivity before signing the contract. Work contracts in progress must be regularized as soon as possible.
