Prohibition of wild posting!

The electoral display is recognized by article 16 of the law of July 29, 1881 relating to the freedom of the press. It is strictly framed by the electoral code. Article L.51 of the electoral code provides that during the duration of the electoral period, special locations of equal area are allocated to each candidate for the affixing of electoral posters. 

In order to reduce the wild posting, the law n ° 2011-412 of April 14th, 2011 simplifying provisions of the electoral code and relating to the financial transparency of the political life authorized the sticking of the electoral posters on the “billboards of free expression where it exists ”. This law also extended from 3 to 6 months the period during which any electoral display outside the display panels.

Any violation of this provision is punishable by a fine of 9000 euros (article L.90 of the electoral code). The format of the posters, the maximum number of reserved spaces and the reimbursement methods are also strictly framed. In addition, the provisions of articles L.581-13 and L.581-30 of the environment code relating to advertising also regulate the display of opinions with a view to protecting the environment. Thus, the regulations in force strike a fair balance between freedom of expression, respect for the environment and equal treatment between candidates.
