Following the publication in the local press of a document from the French Anticorruption Agency (AFA) informing the President of the Community of the implementation of an administrative audit in accordance with article 3 of Law No. 2016 -1691, the community of Saint-Martin confirms that this control is well underway, and wishes to make the following clarifications:
- This control is a standardized administrative audit intended to assess the existence, quality and effectiveness of the procedures implemented by the community to prevent and detect acts of corruption. All communities without exception may be subject to this type of control. In no case was it conducted by referring to a particular case or by targeting specific people.
- The staff of the community appearing on the confidential list wrongly published by the media were chosen by the AFA having regard to the post they occupy in the administrative organization of the community and the background elements and official documents that they are likely to be able to provide as part of this audit. Their probity is at no time questioned.
In the same way as the other controls of which the community has already been the subject (reports of the Territorial Chamber of Accounts), the AFA report will analyze the current functioning of the territorial administration and will formulate recommendations on the means to put implemented to guarantee optimal control over the use of public funds.
The community also specifies that the documents requested by the AFA have already been discussed or transmitted during the various checks mentioned above. The AFA controllers will be on the territory for a period of one week, the community will be at their disposal and will transmit the requested information; the ultimate objective being to improve the public service and respond to ever stricter control of the procedures in force.
It is once again regrettable to note the publication of a document internal to the community without providing the background details allowing public opinion to assess the current situation at its fair value.
