(Frenet school case): Fine and prohibition to practice required against the Pôle Emploi advisor

She explains that she was overwhelmed with work at the time, that she was also pressured by results and recognized mistakes and a lack of vigilance.  While the Héritier family's defense on this aspect was to instruct the Pôle Emploi counselor who ultimately had control over the data that she entered by computer, Marika Andriulli's lawyer presented her as the “victim of the maneuvers of a family of notorious crooks ”. In addition to the negligence of her client, she pleads the agency's dysfunctions and the responsibility of her superiors. Finally, the defense lawyer emphasizes that Marika Andriulli did not benefit from these subsidized contracts and requests his release.

For the prosecution, the employer cannot go behind each of its agents and the material elements do not fall under "nonsense or errors". "It is the responsibility of the Pôle Emploi agent who must make minimal checks" advances the vice-prosecutor who requires a fine of 5 euros including 000 suspended and a ban on employment in the public service or in an association which has a public service mission. The matter was put under advisement on May 3000.
