Intimate partner violence for tearing up a passport

Last Thursday, in Saint-Martin court, Mr. P. was heard for intentional domestic violence committed on his concubine on June 4. 

In her deposition at the gendarmerie on June 6, the young woman specifies that her partner gave her several slaps and strangled her following an argument they had concerning her infidelity in the couple. Mr. P. does not deny the facts, on the contrary he explains that he was already married when he met the young lady. According to him, he hit the latter because she seized his passport and then tore it apart, an act which made him furious. Before the judge, the woman claims to have torn the passport voluntarily during her jealousy attack. An act that the president interprets as giving a stick to the partner to hit her.

While explaining to the latter that she does not have the right to destroy an administrative document. But for the deputy prosecutor, despite the fault of the young woman, the man committed an offense and the facts are well characterized. Guilty of the facts, the court sentenced Mr. P. to 3 months in prison with a simple suspension. _KL
