Water networks in Orient Bay: repair works are the responsibility of ASL

The administrative court of appeal of Bordeaux seized by the ASL of the Résidences de la Baie Orientale ruled in favor of the COM, which in 2015 forced the ASL to carry out work to repair the drinking water and sanitation networks.

The litigation

In 2012, Générale des Eaux noted numerous and significant leaks in the drinking water network of the Residences of the Orient Bay managed by an ASL (free trade union association) of the same name.

The WDM no longer wants to supply the sector as long as the ASL does not carry out network repair work. However, the latter considers that it is not its responsibility to do so; according to her, they are the responsibility of WDM.

The litigation is settled provisionally: the leaks are plugged but the bottom of the problem remains. The president of the Community, Aline Hanson then notified ASL in June 2015 of a formal notice “to ensure, by any means, the reduction of attacks on public safety, security and sanitation caused by its public transport networks. 'drinking water and sanitation failing'.

ASL contested this decree by referring it to the administrative court which, in June 2016, agreed with the COM. In October of the same year, the ASL appealed against the judgment. The Bordeaux Administrative Court of Appeal was seized of the file, including the decision rendered
