JUSTICE: Two men and a woman tried for fraud and / or endangering others

After three dismissals, the fraud case against a background of tax exemption as part of a real estate project in Grand Case was examined last Thursday by the local court of Saint-Martin. The defendants are an architect (JMJ), a developer (LD) and a real estate agent (CG). The first is accused of fraud, the other two of fraud and endangering others.

The facts took place between 2008 and 2014. LD leads a real estate transaction in Grand Case in tax exemption. For a lot of 20 housing units, he called on a young architect, JMJ. "Under pressure from the promoter", JMJ made false certificates of end of work which allowed the promoter to tell his clients that their apartment was finished and therefore that they could take advantage of the benefits of tax exemption. At the same time, the real estate agent provided false leases to complete the file.

In addition, the promoter and the real estate agent  are accused of endangering the lives of others. Indeed, if some rental contracts included "fictitious names" according to the investigators, some were indeed signed with real tenants while the apartments were not finished.

The prosecutor qualifies this file of "fraudulent assembly". He requires the greatest penalty against LD, a fine of 100 euros and twelve months suspended prison sentence. Against the real estate agent he requested a fine of 000 euros and six months suspended prison sentence and demanded a fine of 50 euros for the architect. After deliberation, the court reclassified the charges against JMJ as false and sentenced him to a fine of 000 euros, half of which was suspended. He pronounced a six-month suspended prison sentence and 10 euros against the real estate agent and eight months suspended prison sentence and 000 euros against the developer.
