At the end of August 2019, a violent argument broke out between two young people in Quartier d'Orléans; both were injured, one seriously. VL and FM, aged 23 and 39 respectively, were prosecuted in particular for violence with the use of a weapon, in this case a shovel for one, a bicycle for the other. They were summoned to the local court of Saint-Martin on March 4, only FM assisted by a lawyer was present at the hearing.
On the day of the incident, FM goes to collect his things from his ex-girlfriend who was cheating on him, when he is taken to task by VL. Quickly the situation degenerates. FM tries to hide in his car but VL throws a stone at him and breaks the window, which is why he is also accused of degrading good. Two other people, probably called by VL's mother according to the prosecution, will arrive in support of VL.
FM grabs a nearby bicycle and throws it towards VL. He also threatens him by telling him "I am going to kill you" which is why he is also prosecuted for threat of death.
Then VL grabs a shovel and hits FM in the face and goes to break his jaw; FM will have a four-month work break. The elements of the investigation also show that a machete was used.
FM is a civil party, requests the appointment of a medical expert and 46 euros in provision as well as 300 euros under article 2-000 of the code of criminal procedure.
For the deputy prosecutor, this brawl is "of rare violence, of extreme violence" and considers that VL is "at the initiative". He is seeking a two-year prison sentence and an arrest warrant. On the other hand, he considers that there is "not enough convincing facts proving FM's guilt".
After deliberation, the court acquitted FM and sentenced VL to a sentence in accordance with the requisitions. A medical expertise has been ordered. He also granted 5 euros in provision and 000 euros under article 1-000 of the Code of Criminal Procedure.
