EC was summoned last Thursday before the local court of Saint-Martin for having imported to Saint-Martin 2,35 kilos of herbal cannabis from the United States by post.

On July 21, the gendarmes were informed by the Sint Maarten police of the discovery at Juliana airport of 2,35 kg of herbal cannabis in a package destined for the French side.

The police seize the drugs, take a photo and return the empty package to the delivery circuit of the international transport company. She also tells the gendarmes the name of the recipient of the package (a friend of the defendant) and sends the photo of the seizure.

Surveillance was quickly put in place and a few hours later EC was arrested by the gendarmes and placed in police custody. At the bar, EC confirms that the drug was for his own consumption. She admits to being a regular cannabis user, she smokes two to three joints a day.

The prosecutor requested a one-year prison sentence and a fine of 1 euros.

In defense, the lawyer, Maître Marion Tillard, endeavored to demonstrate that there was no material evidence to prove it. “My client was approached with an empty package… The package was empty,” she stressed on several occasions. “The Sint Maarten police did not provide the gendarmerie with any report relating to this seizure. There is no document proving the quantity of drugs seized. No PV either indicates that the content seized was indeed cannabis, no test was carried out to verify it ”, she insists. "The only element we have is a photo, a photo of the cannabis that was supposedly found in a package on July 21 ... a package that was returned empty to the distribution circuit", observes Maître Tillard. . And to hammer out: "there is no seal in the procedure". Neither on the French side, nor on the Dutch side.
