Placed in police custody, LD recognizes the facts but denies having pointed the blade of the knife towards the victim. "I've been squatting there for eight or nine months. I'm not safe, so I was scared when I saw it coming. ”
LD is not his first encounter with the law. He already has several convictions to his credit, most of them for aggravated theft. The court was also considering another case on Friday February 1. At the end of June 2018, the manager of a grocery store had filed a complaint against LD It had been several days since the young man had come and used himself in his store (drinks and food). He estimated his loss at 300 euros. "They will tell me that it is not the prison that will help him but when we gave the means to the person concerned to get out of it he did not take it up and we see him regularly in court" notes the vice-prosecutor who then declares: "at a given moment we are without pity". It requires six months in prison, the revocation of the suspended sentence (therefore four additional months) and a warrant of committal.
The defense lawyer highlights the difficulties of his client: "he has no door to lock so he carries a knife to respond if necessary". He pleads the absence of material and moral elements concerning the acts of violence. As for the theft in the supermarket, the offense is not for him either.
After deliberating, the court found LD guilty of the alleged acts and sentenced him to eight months in prison, ordered the revocation of the stay (therefore four additional months in prison) and a warrant for deposit. He receives the constitution of civil party of MD and condemns LD to pay him 300 euros of damages.
