Seven lawyers, four defendants, fourteen victims, eight hours of hearing. The criminal court of Saint-Martin examined Thursday, January 24 a complex case in which P. AV, manager of a garage in Concordia is implicated for concealment, breach of trust and insurance fraud. At the same time, MJY.P, 63, born in Reunion, automotive expert, is being prosecuted for complicity in fraud. 

"P.AV used the same mechanism, with a few variations, to divert insurance claims," ​​said the lawyer for an insurer, a civil party. The car rental company uses knowledge, or uses stolen identity and bank documents to have a claim declared on the cars of its fleet. The expert appointed by the insurance companies is the same each time: MJY.P. The drivers supposed to be involved in the accidents, whose rental company has a photocopy of the papers, deny having been in the territory at that time. Some even claim to have never set foot on the island. Most of them only reported the theft of their papers several months earlier. At the helm, P.AV cannot be dismantled. Just like in police custody, he recognizes nothing and has an answer to everything. His lawyer will plead: "there is nothing to confirm that there was no disaster".

P.AV is also accused of concealment for having replaced the serial number of a stolen car with another of the same model declared as a wreck, for having used the plates of one on the other, etc. He also appears for acts of breach of trust. In this case, he repeatedly rented and sold as if it were his own, the vehicles that an individual, then a bailiff had given him as security. According to the defense lawyer, the garage owner "fulfilled his security duties: they had to be rolled over". He requests the release of his client.

Finally, P.AV is also accused of other fraudulent acts also denounced by his ex-employee and his companion. The couple claims to have been a victim of it a few days after OA's statements to the gendarmerie. The couple put the PC vehicle on sale through the classified ads and concluded a 12-euro transaction with the buyer. However, he made a bad check. The investigation will establish an indirect link between PC and P.AV, and direct between PAV and the original holder of the check without funds. However, the buyer denies the facts.
He is absent at the hearing but represented by his lawyer, for whom the fact of being involved only by a victim is not enough to incriminate him. As for the lawyer of P.AV, nothing is proven.

The vice-prosecutor requires against P.AV 24 months in prison including 12 suspended, 5000 euros fine and the ban on running or managing a business related to the rental and / or repair of automobiles for five years. As for the expert, the prosecution requires four months suspended prison sentence and 1000 euros fine. Six months in prison against OV, in whose hands the vehicle stolen from the OA / PC couple was found a year later, are also required. But also three months in prison against PC, the buyer of the vehicle who delivered the bad check. Then three months in prison suspended for D.FL who had registered a vehicle on the Dutch side at the request of P.AV. The judgment was put on deliberation on February 28.
