No one had realized this administrative loophole until it created certain problems. In Saint-Martin, it is indeed the Collectivity which legislates in matters of technical control and not the State as in mainland or in the DOMs, because it has the competence road traffic and transport. In other words, technical control is compulsory in Saint-Martin, but its procedures and the list of points to be checked do not appear in any document from the COM. However, in this kind of situation, local measures that pre-date jurisdiction are applied locally. The technical inspection in its 2012 version must therefore apply to Saint-Martin.
