Under the impulse of the majority, the territorial council of Saint-Martin ratified, Tuesday, May 15, 2018, a deliberation aiming to modify the general tax code of Saint-Martin to simplify the collection of the general tax on the turnover business (TGCA).
In order to prevent Saint-Martin customers of these foreign companies from paying back the TGCA in their place due to the reverse charge rule, the territorial council decided to abolish this rule and thus to force foreign companies (metropolitan area - dom com - or coming from a foreign country) to donate the TGCA themselves to the community that they will have collected locally from their customers. These new obligations will apply to transactions carried out from July 1, 2018.
To fulfill their obligations, these companies must imperatively make themselves known to the Saint-Martin Public Finance Center in order to declare their activity in the territory and obtain an individual identification number at the TGCA.
President Gibbs reminded the meeting that any company operating in Saint-Martin is required to declare and fulfill its TGCA.
