Conditional prison and fine in particular required for having forced a roadblock

The court of Saint Martin last Thursday examined a case of refusal to comply and violence against a gendarme.

On September 21, JP.F., 71, retired and company director, is on his way to Grand Case airport to travel to Guadeloupe for professional reasons. On that day, traffic is prohibited after 14 p.m., a succession of meetings put him late. The mention "priority vehicle" is written on his 4X4 and he has an authorization to access the airport from the prefecture.

When he arrives at a gendarmerie barrage, he follows an emergency vehicle. The gendarmerie chief warrant officer motioned him to slow down, but JP.F. continues to advance and collides with the constable's left leg. The latter will manage to catch up with JP.F. and smash the glass with a telescopic baton. He then grabs JP.F. through the collar and out of the vehicle. The driver then telephones the general who then gives the order to the gendarme to let him go.

The deputy prosecutor requested a two-month suspended prison sentence, three to four months' license suspension and a fine of 1 euros. The judgment was put on deliberation on April 500.
