Since the beginning of the events, we have heard a lot of words about the natural risk prevention plan (PPRN), the main ones being withdrawal, suspension, cancellation, correction. Some are inappropriate, others must be interpreted correctly.
• Cancellation or withdrawal of PPRN
The PPRN of Saint-Martin cannot be canceled or withdrawn insofar as it was set up in 2011 by the State after a favorable opinion from the elected officials. No valid reason from a legal point of view today allows its cancellation or repeal in administrative jargon.
• "Stay of proceedings"
Monday, the Minister of Overseas admitted that the "PPRN [should] be corrected" and affirmed that it will be it by a mission which will come from January 2020 and of a committee made up of local personalities. Even if it did not say it directly, the correction of the PPRN supposes the postponement of its final application to next year.
The next day, she confirmed it by using another term with more impact: she indeed announced "the stay of the proceedings". However, this is the procedure under review, not the 2011 PPRN.
In other words, the state will not apply the new version of the PPRN by the end of the year as it intended. Annick Girardin clarified that a period of three additional months was granted to "correct" the by-law and the zoning developed.
