The territorial councilor, member of the opposition, reacted by press release following the adoption of a deliberation in the territorial council on July 1.
On July 1, the territorial council unanimously adopted the deliberation aiming to grant a loan guarantee for the benefit of SEMSAMAR following loan reorganizations.
“Our SEM has recently reorganized eight loans contracted with the Caisse des Dépôts et Consignations (CDC), for a total amount of € 6 million. It is above all a question of extending the repayment period in order, for SEMSAMAR, to gain in self-financing capacity to reinvest here, in Saint-Martin ”indicated Daniel Gibbs at the beginning of the deliberation. And to specify that the initial loans were already guaranteed by the COM and therefore that this deliberation had "no impact on the finances of the Community".
This deliberation followed a letter dated October 6, 2020 and addressed to the president of the COM, in which the CEO of SEMSAMAR, Yawo Nyuiadzi, wrote: "We have the honor to communicate to you the draft deliberation established by the CDC to be submitted to the consideration and decision of the Deliberating Assembly of your Collectivity. ". Absent from the territorial council, Louis Mussington reacted a week later by press release: "After reading this communication, we would like to point out to you that the latter [the letter mentioned above, editor's note] remains irrefutable proof of the control that the CDC on the SEM.
It is necessary to recall that a request for debt reorganization, relating to loans contracted with the Banque des Territoires had been formulated by the former director with the same objective, namely, to enable Semsamar to gain in self-financing capacity. It would seem that this request did not benefit from the support, neither of the CDC nor of the president of the Collectivity. Three years later, the same strategy is examined and supported by the Banque des Territoire and the guarantee is approved by the majority of the territorial council. »Denounced the territorial adviser and leader of the MJP.
As a reminder, on March 1, 2019, Louis Mussington seized the administrative court of Saint-Martin to ask it to cancel the deliberations of the territorial council of December 13, 2018 approving a change in the mode of governance within Semsamar and the candidacy of Yawo as President and CEO of Sem. On February 11, 2020, the administrative court ruled in favor of Louis Mussington and canceled the two deliberations of the territorial council on the grounds that insufficient information had been given to elected officials so that they could position themselves on the issue. Judgment which did not call into question the choice of the mode of governance but only the decision of the territorial council to approve this choice and that of the candidacy of Yawo Nyuiadzy for the post of CEO.
