On January 15, an argument broke out between two brothers; one of them, DR, carries a gun and injures his brother in the stomach. DR is arrested and prosecuted for aggravated violence. He was summoned Wednesday morning before the local court of Saint-Martin for immediate appearance. As the law allows him, he asked for a delay to prepare his defense, he will be tried on March 16 in Basse-Terre.
However, the court had to rule on DR's legal situation: leave him free, place him under judicial supervision or in pre-trial detention.
For the prosecution, DR “has no guarantee of representation” on the day of his trial. So he asked that he be imprisoned. "The day before the facts, DR had already appeared in court for causing injuries on a scooter, the same evening he got drunk, had an altercation with his brother and injured him in the stomach", explained the prosecutor who said also recalled that DR was sentenced in November 2020 to fifteen months in prison for participating in an armed robbery.
Three other convictions are entered in his criminal record: one for using narcotics in 2012 and two others in 2016 and 2017 for having participated in thefts and detained a firearm.
DR's lawyer requested that her client be placed under judicial supervision. She provides two certificates to support her request: one from her brother who has not filed a complaint and has not become a civil party and one from her mother who claims to need her son by her side to help her. daily ; both were present at the hearing.
After deliberation, the court ordered provisional detention in the Basse-Terre remand center.
