A new case of work concealed in a Chinese convenience store was examined yesterday by the local court of Saint-Martin. It is at least the sixth called for a year and a half without counting those which were fired.
These files are similar: the co-managers are Chinese nationals who are not authorized to work on French territory and / or who have not declared their own salaried employment.
At the helm, the co-managers always hold the same speech: they are partly Dutch residents, have bought a partly French mini-market and perform management functions, cash register, shelving, sales, etc. In all cases, the companies are in order, only the co-managers are not declared. "Out of ignorance", they confide.
Yesterday morning, a co-manager repeated what her compatriots had already explained: she does not speak French, does not know French law, so she has secured the services of an accountant. “He takes care of all the administrative procedures and assured us that we could be co-manager in part French and work. He had experience, so we trusted him, ”she says. This is not the first defendant to make these comments.
The counsel of the defendant today added to have contacted the accountant of his client. "He told me: you are a lawyer, I am an accountant, I have done more studies than you, I have more experience than you and our common clients have the full right to manage a business in France in being a foreigner and working. I showed him the legal texts that say the opposite, but he did not want to show me the texts on which he relied to assert what he was saying ", specifies the council which has also confided to consider initiating a legal proceedings against the said accountant.
In this morning's case, the prosecution requested a fine of 7 euros and a ban on engaging in commercial activity. After deliberation, the court ordered a fine of 000 euros. (soualigapost.com)
