The administrative court of appeal of Bordeaux rejected the request of Sarl Le Privé.
The latter had seized it to annul the order of the summary judge of the administrative court which stipulated the suspension of the execution of the tacit building permit issued by the COM in February 2017. The judges' arguments are as follows: the file is not complete and certain rules of the land use plan (POS) are not respected.
As a reminder, in February 2017, Sarl Le Privé had applied for a collective building permit for a building comprising 48 dwellings. A tacit building permit was given on September 1, 2017. The executive council will issue the permit in December 2017 and a decree was issued in January. This decree was referred by the prefecture to the administrative court of Saint-Martin.
